PURCHASE-SALE AGREEMENT

The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart (hereinafter referred to as the Shopping Cart), clicks on the “ORDER” link.

Upon conclusion of the Purchase – Sale Agreement, the assortment of goods, their quantity, price, delivery time and other conditions specified during the execution of the Buyer’s order are binding for both the Buyer and the Seller and can only be changed in accordance with the procedure set forth in these Rules.

Sales contracts are registered and stored in the https://kitchenjulie.com database.

BUYER’S RIGHTS

The buyer has the right to purchase goods in the online store https://kitchenjulie.com in accordance with these Rules.

The buyer has the right to refuse the contract of purchase and sale of goods concluded with the online store https://kitchenjulie.com by notifying the seller in writing (by e-mail, indicating the desired return of the product and its order number) no later than within 7 (seven) working days from the day of delivery of the goods.

Buyer’s rights The buyer’s right discussed in point 2 is implemented in accordance with the 2001 August 17th regulation of the Minister of Economy order no. 258 of the approved rules for the sale of goods and the provision of services when contracts are concluded using means of communication.

The Buyer’s rights are discussed in article 2 of the Buyer’s Rights. The Buyer can only exercise the Buyer’s right if the product has not been damaged or its appearance has not fundamentally changed, as well as if it has not been used.

BUYER’S OBLIGATIONS

The buyer must pay for the goods purchased from https://kitchenjulie.com and accept them in accordance with these Rules.

If the Buyer, during the delivery of the goods, refuses to accept the goods without good reasons, the Buyer must cover the costs of delivery of the goods.

Buyers of the online store https:/kitchenjulie.com must comply with these Rules, as well as the conditions clearly indicated in the information sections of the online store, and must not violate the laws of the Republic of Lithuania.

SELLER’S OBLIGATIONS

The seller undertakes to make it possible to use the services of the online store, the operating conditions of which are determined by these Rules and other conditions published in the online store https://kitchenjulie.com.

The Seller undertakes to deliver the goods purchased by the Buyer to the specified address based on the conditions established by these Rules.

The Seller undertakes to respect the Buyer’s right to privacy regarding his personal information.

In the event of unforeseen circumstances, when due to unforeseen circumstances, the Seller cannot deliver the goods purchased in the online store http://kitchenjulie.com, the Seller has the right to terminate the purchase-sale contract by notifying the buyer beforehand. The Seller can offer a similar product, if the Buyer refuses, the Seller undertakes to return the money paid within 5 (five) working days.

After the Buyer has exercised the right provided for in point 2 of the Buyer’s Rights of the Rules and in case of the conditions stipulated in point 4 of the Buyer’s Rights of the Rules, the Seller undertakes to return the money paid to the Buyer within 7 (seven) working days, calculated from the day of receipt of the returned goods.

PRICING OF GOODS

The prices of the goods in the online store and in the order made at https://kitchenjulie.com are indicated in euros.

TERMS OF PAYMENT FOR GOODS

The buyer pays for the purchased goods in one of the following ways:

  • Through the payment partner system paysera.lt.
  • Payment by Paypal.

The buyer undertakes to pay for the goods immediately when paying in the ways discussed above. Only after he has paid, the goods parcel will be formed.

After the buyer chooses the desired goods and concludes the contract with the seller, the order information will be sent to the e-mail address specified by the buyer, and after payment, an invoice will be sent. Invoices indicate the items selected, their quantity, discounts granted, the final price of the items including all taxes, and delivery charges.

DELIVERY OF GOODS

The online store https://kitchenjulie.com undertakes to deliver the goods to the Buyer no later than 10 working days after the confirmation of the order. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances. In this case, https://kitchenjulie.com undertakes to immediately contact the Buyer and coordinate the delivery of the goods. Shipping of goods is carried out by UAB Shipaway – goods are sent from the warehouse within 1 working day and are usually delivered by couriers in Lithuania within 2-3 working days.

When purchasing goods in the online store https://kitchenjulie.com, the buyer can choose from several methods of delivery of the goods:

  • Courier services – delivery to the recipient’s address in Lithuania.
  • Courier services – delivery to the selected parcel point.

The buyer undertakes to indicate the exact place of delivery of the goods. It is especially important to specify the correct zip code in the order form, as the courier delivers the goods based on it and the phone number through which you can be contacted.

The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

After receiving the goods, the Buyer must, together with the Seller or his authorized representative, check the condition of the shipment and the goods(s) and sign the invoice, waybill or other document of delivery and acceptance of the shipment. After the buyer signs the invoice, waybill or other document of delivery and acceptance of the shipment, it is considered that the shipment has been delivered in a suitable condition, the damage to the goods, the origin of which cannot be attributed to a factory defect, and the inconsistencies in the package of the product(s) (such as can be determined by inspecting the exterior of the goods ) there is no. Upon noticing that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the Buyer must note this on the invoice, bill of lading or in another shipment transfer and acceptance document and contact the Seller. If the Buyer does not perform these actions, the Seller is released from responsibility towards the Buyer for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined by inspecting the outside of the goods.

The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.

GOODS QUALITY GUARANTEE

The characteristics of all goods sold are indicated in the description attached to each item.

The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

EXCHANGE OF INFORMATION

The Seller communicates with the Buyer using the e-mail provided by him. e-mail address, and the Buyer can use all communication channels specified in the “CONTACTS” section of the website of the online store https://kitchenjulie.com.

RESPONSIBILLITY

The buyer is fully responsible for the correctness of the data provided. If the Buyer provides inaccurate data, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.

The Seller is released from any responsibility in all cases where losses occur due to the fact that the Buyer, regardless of the Seller’s recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

If the Seller’s online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise, control those websites and does not represent those companies and individuals.

In the event of damage, the guilty party compensates the other party for the losses incurred in accordance with the procedure and grounds established by the legal acts of the Republic of Lithuania.

SELLER’S MARKETING MEASURES

The seller can carry out various types of promotions, change their terms and terminate them at any time.

The seller has the right unilaterally, without separate notice, to change the conditions of the shares, as well as to cancel them. Any changes or cancellation of the order of the conditions of the shares are valid only going forward, i.e. from the moment of their execution.

FINAL PROVISIONS

MB Kitchenjulie reserves the right to suspend, at its sole discretion, complete, change these Rules and other documents related to the Rules. Additions or changes to the rules take effect from the date of their publication.

If the Buyer does not agree with the new version of the Rules, partial additions, changes, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the online store.

These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.

Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.

All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania according to the Seller’s place of registration.

The parties are released from fulfilling their obligations under these Rules if their fulfillment is impossible due to force majeure circumstances.
